HARASSMENT FROM SMARTBRO

In 2011, after finding utter disappointment from two (2) major internet providers in the Philippines, hubby went to a Smart Wireless Center and applied for a Canopy Device.  When the unit was delivered,     the installers suggested that we avail of the Wimax instead since the trees around the neighborhood were blocking the signal.

So, they came back later and delivered the Wimax device.  The contract was locked for two years, otherwise, we had to pay pretermination charges.

On the day that Pacman lost to Marquez, on Dec. 9, 2012, we discovered that we had no internet signal.  This had happened many times before, sometimes lasting for a few hours, and the most was three days. We never a reversal of the charges since it was too much of a hassle to call their customer hotline at *888.  After two or three days of no internet signal (it was forever a running light), we reported the matter to the hotline. The customer service officer merely said to monitor the device for a another 24 hours.  

After a few days, the device was still not working (imagine leaving it plugged, with a running light, 24 hours a day, and I can't use it, but I had to plug it on. The useless consumption of electricity, right?)   When we called the hotline, the officer asked us to bring it to the center for replacement because it was broken.  So hubby went to the Wireless Center to report it and was told that the device will be replace, but to just wait because they had no idea when a device would be available.

So we waited...

And waited...

And waited...

A few weeks after, we called the hotline and asked for an update. Still the same answer- they didn't know when a new device would be available.

After many follows ups, I got a bill for the internet that we could not use. So I called the hotline and they advised me to pay the outstanding balance and have it reversed later.  So I said, "you mean, in the more than one month that we have been waiting for an internet connection, I still have to pay?" "Yes", he said, "but you can have the charges reversed when service resumes."  I asked, "and when may that be?" He said, "he doesn't know." So I said, "please put this in record that we will not pay because there is no internet service. Why pay for a service that you weren't able to use because of the provider's incompetence?

I followed it up to no avail. 

I even sent messages to follow up my reference number to its twitter account @SMARTcares. I never received any reply.  That's how much SMART CARES: it ignores you until you collapse and get tired from all the follow-ups. I've sent emails too and they did not reply. 

To shorten this depressing story, sometime in March we received a notice of disconnection from Smart. Asking us to pay P12,000+++ for the two months that we had no internet plus pre-termination fee of about P10,000.00.

After that, we have been getting text messages from an ADA Law Office.   This afternoon, I received another text message from an office claiming to be the ADA Law Office:

"FINAL SERIOUS DEMAND ( as if we're joking here ----- my addition, not part of the text)

This is A.D.A. Law Office.  Your silence & non response to our previous demands indicates your malicious & unjustified refusal to pay a just and demandable obligation on your SMARTBRO.   Thus we urge you to settle your outstanding obligation until May 05, 2013 from receipt of this message.  (ano daw???)

Otherwise, our law firm will definitely proceed with the filing of appropriate legal action against you pursuant protect the interest of our client SMARTBRO.  Any question (hmm) please call (02) 3818527 and look for MS. DELOS REYES.  thank u"

Previous text messages contained a different contact person, but the same A.D.A. law office. 

I have been checking the list of the law firms in the Philippines and I have yet to see A.D.A. Law Office. If indeed there really is such an office, then that lawyer must be really desperate to get his contingent fee the at he had closed his eyes to the real issue at-hand, and that is, his client (Smart) failed to serve its own client (us).  If it's a collection agency, which I think it is, then I have been hearing bad things about them-- harassment is the most applicable word.  

I even tried calling it this afternoon, introduced myself as a lawyer, and they said they'd make a return call.  Up to now, there's no return call. 

Another push and I'll file a complaint with the National Telecommunications Commission.

Which brings me to one point of thought- the lock-in period should not be imposed by internet providers.  Because even if their service sucks, the consumer is still the one who loses more with the lock-in period.  Add to that, a simple Filipino may get easily harassed by these oppressive telecom giants. The price of technology --- a way for these telecom giants, particularly SMART to milk us for every cent we are worth.

I went to Smart store to have our SmartBro voluntarily disconnected, unfortunately I was told they won't allow it because we're in contract of their lock in period. In short we'll be paying the remaining months that completes the 24 month lock in period.

Personally, I will not pay it. How would you pay for unstable or no internet connection at all.

Kaya may lock in period kasi walang guarantee ang smart na makaka deliver sila ng matinong internet connection. Remember their promise "upto 1 mbps". Pag titignan mo naisahan tayong lahat, pag ang internet connection mo ay 1 byte basta upto 1 mbps yan, yan yung sabi sa marketing nila na "upto 1 mbps".

Lumipat na ako sa PLDT myDSL maganda ang service so far. Hindi ko babayaran ang Smart hindi dahil sa walang pambayad kung hindi dahil wala akong serbisyong natatanggap (unstable internet connection)sa SmartBro nila.

If in 5 months from now, I will recieve those demand letters, I will just disregard them, and it will not affect me at all.

Most probably collection agency yan, puro final demand lang yan at pag hindi ka nagpa pressure ililipat nila ulit sa ibang collection agency. haha Maging handa ka na lang depensahan sarili mo sa pang i insulto o pambastos na yan (collection agency), i complain agad sa barangay. Yung Smart naman pwede natin i complain sa National Telecommunications Commission at DTI para sa paglabag sa consumer protection. Wala naman tayong natatanggap na serbisyo, paano sila nagkaroon ng lakas ng loob maningil. Very oppresive nga ang mga 24 month contract na lock in period.

Hindi ba't sila ang lumalabag sa breach of contract regarding sa services rendered?
Sana silipin yung "upto 1 mbps" nila kasi dyan tayo nalusutan. so kahit anong speed kahit na i deliver nila 0.00001 mbps pasok sya sa upto 1 mbps. tsk tsk tsk

Napaka-oppressive talaga ng lock-in period nila, wala namang kwenta ang service.

Sayang nga, mabilis pa naman sana ang service, kaso nga lang, pag nawala, tuloy-tuloy!!!


grrr, wala tuloy akong internet ngayon, kelangan ko magtiyaga sa computer shop. Hay!

hello! naku, super bad talaga! ngayon, ang sinisingil na lang nila sa akin yung payment for 2 months, tinanggal na yung pre-termination fee. But I am still going to file a case against them at NTC.

Nakakainis talaga, parang criminal ano!

ako rin cnisingil nila...since i purchase it- diko talaga nagamit kc hindi manlang mgkasignal...i request refund, ang sabi kelngan mpuntahan ng technical support nila...It is been 2 months wala p rin- cla na may kasalanan dun...sabi ko iterminate ung 24months lock in period kc wala ako napala... ayoko magbayad hindi ako bobo-dapat matigil na yang unfair operation nila- kawawa yung walang alam sa law na nagbayad dahil sa love letter nila na pnanakot na kesyo magffile ng kaso.

Something must be done nga po regarding the lock-in period eh. While ok yung lock-in period, dapat naka-condition yun sa pagpo-provide ng network ng reliable signal. Napaka-oppressive naman po kung walang signal tapos for 24 months, magbabayad tayo diba, tapos hindi naman natin napakinabanagan?

Nakakadala tuloy kumuha dito sa mga network giants kasi kayang kaya nilang apakan yung hindi masyadong nakakaaalam.

Hi po! I need your help guys :( Wala pa pong 1 month ang connection namin and I've been asking my friends if pwede bang ipa disconnect agad agad. Unfortunately, may lock in period. So, ok lang bang bayaran ko yung 1st bill and huwag na sa susunod? And makakapag apply ba ako nyan ng PLDT my dsl kung may unpaid bills ako sa Smart Wimax?

Hello po! Kung ang reason niyo naman po ay valid, like walang signal, sira ang device, etc, pede naman kayong mag-stop ng payment. Ang problem po kasi, yung pre-termination fee na sinasabi nila. Pwedeng ilaban niyo na lang po sa customer service yung complaint niyo, if may valid complaint kayo.

Dapat nga kasi, wala na yang lock in period na yun kung di naman satisfactory ang binibigay na service eh.

same are... 3yrs +3mons na yun account ko sa knila , gusto ko nataggalin kasi pangit n yun services nila , pero ayaw ipatanggal ng SMARTBRO kasi daw renew ko daw yun contract , sabi ko may pinermahan ba ako , sabi nila wala pero approve daw ako sa phone , aba auto renew ba ? walang perma... ayun di ko binayaran , until last month and now katanggap ako ng text sa A.D.A Law Office , too settle yun remaining balance. pero unfair if makikipagsettle ako kasi bulok na nga services nila , bastos tech support nila (smart pampanga) at tapos na 2yrs ko pero sila nag-autorenew mag-isa... if makaluwas ako plan ko magcomplain sa NTC regarding this matter.....

dapat nga po talaga nagrereklamo tayo para aware ang NTC. Dapat alam din ng law office na yan kung gaano kabulok ang client nile bago sila magpadala ng kung ano-anong demand letters.

Mine is a little different. Since I had that smart canopy installed last June, I have never received a single hard copy of my bills. They do send me a summarized amount via email but it also said that I am still supposed to receive those hard copies. I availed for a plan 1299 buy I had charges that went up to 1500 and even 1800. Of course I want to see those charges in detail. I've lost count on how many times I've called them about this but still nothing. I've logged all the details on each call i Ade from dates to the names of their agents I've spoken with. Then early this month I think they finally disconnected it
I'm not sure how to deal with this situation really but as far as I know, I'm not really at fault here. I do know my rights and u want to know what exactly I'm gona pay for. And yes their service is absolutely horrible.

yes, me too.. right at this moment i received a letter from a law firm LDRP.. a year ago, a month before my contract ends with them, walang cgnal totally.. so, sabi ko what actions will they do about the prob, sabi hintay lang daw.. tapos sabi ko i wave nyo nlang 1 month remainings a contract ko and d nko renew.. kc 2nd time ko ng renew un.. sabi settle ko daw muna yung payment.. e sira pla sila, bakit kobabayaran ang d ko nmn nagamit.. then un, tapos n contract ko and d kon binayaran yung lastmonth.. tapos ngayon naniningil cla ng almost 13k? pakshit cla..

nweiz, what can we do about this? if kc ako lang mag1 punta at magreklamo sa NTC, pakikiNggan kaya ako? sana may magawa tyong paraan about this..

Dapat talaga alam ng mga tao ang karapatan nila. It just saddens me that these companies have the tenacity to give substandard service yet have the audacity to threaten the consumers for non-payment because of lousy service. this should be stopped. I wonder if the NTC is doing something about thi.s

ganyan din ung situation namin ngayon. ngbigay sila ng Final notice of Disconnection tapos nananakot pa na, parang mgsasampa sila ng kaso etc. totoo kaya yun?. hindi na kasi kme ngbabayad ng bill ng smart, puro palya at palpak nman. lagi nlng walang internet, nakakapagod ng mkipag usap sa CSR.
Nakakatakot nman yung mgsasampa pa ng kaso, tapos pirmado pa ng atty.

Also tried talked to an agent at Smart SM Taytay, to disconnect my smartbro xe di na magamit.Tapos kailangan ko daw magbayad dahil di natapos yung 24Months contract. .....Seriously... its bullshit..

Then reported it to NTC on their website,then someone from NTC forwarded my report to smart.

it took them ttwo months to visit/checked the smartbro unit. they only replace the rj45 connector.... loose connection daw... wtf... kahit di sya palitan connected naman sya sa network....
yung browsing problem di naman na-resolved...

www.google.com lang nga hindi ma-load. tapos byaran daw yung unpaid bill...

Mga siraulo pala sila...

di na nga magamit bayayaran mo pa yung serbisyo na walang kwenta...

Naka receive din kasi ako last month ng letter na kailangan din magbayad ng more than 15k. Nag stop na rin kasi ako sa pag babayad kasi palpak yung serbisyo nila. Tatanong ko lang kung ano na nangyari sayo after 1 year?

May tumawag din sakin kanina lang from Lauron Delos Reyes Law firm. Kailangan ko daw mag bayad hanggang bukas kung hindi may legal action daw silang gagawin. Any update sa mga subscriber na binabantaan ng Law firm?

Hi Carlo, after a year, wala nang nangungulit sa kin. I tried placing a complaint with the NTC, but there was no action. Buti, the law office stopped hounding me, after I told them that I have no signal for at least five months from the time they started calling me left and right. I was advised to go to the customer service na lang to report it.

I told the person from the law office na I've been there many times and there was no action and I got tired of going there and waiting in line, only to be told that they will check it. And the man I was talking to said that he would inform his boss about it and to let them know once signal has resumed.

I said, I will inform him right away. But since I never got anymore reply from Smart (email or call), I didn't call them anymore. And that was the last call I got from the law office. I'm guessing, this was about October of last year.

In short, hindi na ako tinawagan or pinadalhan pa ulit ng demand letter to pay for a service that I did not enjoy.

HI PO. ako din nagpakabit ng smart pocket wifi at wala siyang lock in period. First two months ok siya,although mas madamjng oras na mahina ang signal. The third month, sobrang bagal as in. We decided na ipa terminate nalang. Pero the next month they billed me again 999 pesos kahit wala na signal yung wifi.. Tapos eto me nagte te xt saakin na from law offiice daw

Sinabi ko na nga na nakausap ko na smart hotline, txt pa din ng text! Talaga bang gagawan nila ng problema tayo? Like baka magka hit sa NBI or what. Thank you

hindi ko talaga sila nbabayaran pahamak ang serbisyo nila.

Hi mam ask ko lang po, un smart bro kc namin terminated na un contract last january pa dahil wala din signal then sabi nila inform na lang kami if meron pa kaming rebate. Inisip ko na lang na di bale ng walang rebate basta lang matapos na un problema, after more than 1 month may dumating na final notice dapat daw kaming magbayad bale ang period covered ay un araw na wala kaming internet so tinawag ko sa hotline, sabi ng hotline wala na dw kaming balance so sabi ko bakit ganun dpt ayusin nika un records nila. Binigyan pa ko ng assurance ng hotline na wala na kaming utang. Then all of a sudden after 9months my dumating na notice from a law firm na kakasuhan kami pag d nagbayad.... Dapat ko po bang seryosohin un banta nung law firm na un or balewalain ko na lang po...help naman po pls. Thank u po.

May I suggest to everyone to just ignore them or if you want to be bothered, sagutin niyo na walang kwenta ang service nila at irereport niyo sa NTC.

They can file a case against us, pero our defense is that walang service in the first place. But I don't think they would go to such length. Ang daming complaints against them, ang kapal naman nila. Pang-haharrass lang ang gagawin nila hanggang sa mainis tayo.

Naku, sorry po sa late reply. Basta December po talaga nagkakandarapa ang mga law firm na maningil kasi alam nila na pag Dec. may bonus ang mga tao, so haharrassin nila para magbayad.

Ganyan po ka-halang ang kaluluwa ng mga law firm at ng mga empleyado na humahabol sa quota para may commission.

Hindi ko naman po nilalahat. Pero pag collecting agency po ng credit card, utilities, like phone, networks, asahan niyo po na wala silang pakialam sa kung ano ang tama o mali. Basta may list sila at nandun ang pangalan natin, di na tayo tatantanan.

Hi there. Ung case ko naman ganyan din.Sobrang palpak ung service ng Smart Bro na halos 6 months lang kami merong net. Ilang beses kong fin-follow-up un sa customer service hanggang sa pabayaan ko na lang na wala. But since may lock-in period nga na 24months, tinapos ko un para walang gulo. Ang problema, nung nag-expire na yung contract, eh hindi na ko nagrenew. kaso tuloy-tuloy pa rin yung charge ng Smart Bro saken. lecheness lang talaga. Ilang beses ko na rin sinabi sa mga nangungulit na agents na napawalang kwenta service nila at kung tutuusin eh dapat nga may rebate pa ako dun dahil kahit di ko narereceive yung "service" nila eh nagbabayad ako. Now, nagtext itong certain Lauron Law Firm na ito which completely pisses me off. Pag nangulit pa sila, I'll be forced to file a complaint sa NTC.

Hi, I experienced the same thing with the canopy replaced with Wimax bec of signal problems. I have not paid them for months and now the bills that I am receiving from them would sometimes reach up to 30k then the next bill wud be on a lower price and so on. they are not really consistent. Just this moment I received a call from a Rommel Dela Cruz from CMMS Legal External of SmartBro daw. And is asking why am I not paying my dues, when I'm in the middle of my narration he dropped the call and didn't call me back. Anyway, I wasn't really able to use the connection since their 2mbps can't even access facebook. I asked for a technician, which I usually do in my Bayantel account (on which they respond immediately) but no technician from smartbro came. Guess that was 4 times. I got tired and pissed off so I didn't pay them. Now my mom is really so worried bec of the increasing-decreasing bills reaching up to 30k. What to do?

I suggest you go to ntc.gov.ph to file a complaint. If you want, you can go personally to the smart office to explain and ask for a reversal of charges.

You can always ignore their demands, pero they can be persistent. The best option is to complain to the NTC if you can no longer tolerate their harassment.

Hello. I am also encountering the same harrassment from that firm. My story is, I availed of a smartbro wifi. I have been consistent in paying for the first 5 months despite the crappy service then they stopped sending me monthly bills. I then stopped paying AND USING the device since my other phone's internet is way better than the device. It wasn't explained to me when I purchased it that I still need to pay or else they will charge me. Months went by without any notice nor bill not until my 8th month. I have been receiving messages, mails etc from a law firm telling me that I charges are already filed in a local court in Makati. I went back to where I availed the device to talk to them. They just told me that I need to pay the amount even if I didnt use the device for a couple of months, they will reconnect the service and there will be an option to increase the speed. Instead of being at ease, I became more frustrated and disappointed. If they have a good service (faster internet speed) in the first place, then i wouldve used the service til now.

same here!, its been a year since na wala na ung service ko kasi di nila pinupuntahan hanggang sa pinabayaan nalang nila, ilang beses na aq pumunta sa office nila pero walang solusyon and sabi papapunta ng tech pero wala namang dumadating nung tumawag ako sa tech nila sabi for closing na daw ung lugar namen dahil sa dame daw ng puno na nakaksagabal sa signal, hellooo ang taas ng bahay namen at sa lugar namen wala ni isang puno, tapos ngaun manghaharass ung mga maniningil..

In my case, I have received an awful internet connection from the 3 month onwards. I have regularly contacted the customer service and they have sent a technician ONLY ONCE. On the 6th month, the internet service finally went off. I made several follow-ups and nothing happened. Tapos since meron silang lock-in period na sinasabi, I decided to continue paying for that pesky internet service na never kong nagamit.

Then nung mag-expire na yung contract, this customer service rep kept on calling to continue the service. Sabi ko, NO! HINDI KO NGA NAGAGAMIT UNG SERVICE TAPOS ITUTULOY KO PA UNG KONTRATA? tapos nagulat na lang ako may bill nanamangf dumating. I tried calling the customer service nila at sinabi kong i-cancel yung account. Hindi raw. I made several calls to no avail and finally, ayoko na. Hinaharass ako ng Smart Bro (WiMax) I've been using their service for 2 months and i have a poor experience with it but after 2 months i started experiencing more difficult Connection. I've been subscribed for WiMax Outdoor (2mbps) but i just received an average speed of 15kbps and sometimes nothing 'though i've already experience it from the start, but i still continued my subscription and notified them that i have a serious problem in my internet connection but they said that they will try to fix that but after a month of followup still i have no good internet connection so i called their Customer Service Hotline and i tell them that "i would like to terminate My Subscription but and they said; you need to pay the pre-termination fee worth 8,991.00 pesos and your Current Balance of worth 999.00 pesos but i didn't pay them for not given a Quality Service. And now. After a year i've started to stop paying my bill to them(SmartBro), they send me a text message; here's what they've texted:

This texter might be using some words to make a Psy-war so that i will may quickly make an action to fulfill my bill before their due date even 'though i didn't have a good experience with their service. I did not yet reply any message to them yet. And also, their message seems to be very unprofessional i've been also i a Customer Service and Marketing Department of a Company but i've done any message or letter like that. Also, if they we're about to fill a Case against me i thought they should have to give me at least 30 days from the day(Today) they've send me a notice and that's the proper and legal notice. That message seems to be too unprofessional.

By the way, my problem is; thus they could really fill and Case against me or what?

-yung last letter na nareceived ko October last year nasa 5K+ lang yun and then nung tumawag nung May nasa 13K na daw. 1 month na monthly lang ang hindi ko nabayaran nun pero naging 5K+ na agad. Saka may naalala ko dapat September last year tapos na ung 6-month contract na sila ang gumawa, July last year nung masira ang internet ko, so dapat hindi na yun lumaki ng 13K di ba. Plano ko makipag usap sa smartbro na yung tablet lang ang babayaran ko pero hindi ung internet na hindi ko nagamit. Sana pumayag kasi wala naman akong plano takbuhan yung pagbabayad, nagkataon lang talaga na hindi maganda ang service nila.

me po.. 2012 pa ung nung diko na ginamit pldt nmin since naka aprtment lang kmi. tpos kahapon lanh my tumawag na taga law office dw siya.and asking me to pay 9k.
pero ang txt nya is 23k. sabi ko bat ko babayaran ung diko naman nagamit! mkpag usap nlng dw ako sa pldt pra daw di nila ipadala demand letter skin.hahaha.
by the way nagpakabit po kami 2monyths lang d ko na ginamit kasi lagi DC kesho may problema daw sa area nmin ganun..ang sabi naman smin nung nag install kung ayaw na nmin wag na gamitin kaso block listed lang tlaga

smartbro users po kmi for less than 2 yrs..since the connection is too slow minsan nawawala pa.hanggang sa d kmi nagbayad for 1 month then naputol ung connection..but they send us billing till now.5 mos na po kmi nakabitan ng pldt.kninang umaga I receive a letter from the law office na I need to pay my unpaid bal.worth 4k then my addition na 2k for penalty.if d ko nabayaran within 5 days magbabayad daw po ako ng 100k..d ko naman po nagamit ung previous month kc po pinutol na nila ang connection...nu po ba dapat kung gawin?

I got the same messages din po; I told SmartBro before that I need to disconnect may internet dahil nga sa signal is so bad/worse nothing happen so I stop paying my bills and here comes the text from this number 09988566347 it says; Good Day. This is from the office of Atty Leo Z.Mendoza of Pacer Collection Services Inc, collection agency of smart. Despite all our follow ups on your UNPAID smart broadbrand account payment was not made. You may pay in FULL or in INSTALLMENT. Should we not hear from you soonest, we shall think of means to protect our client's interest, thru legal or otherwise you may avoid this inconvenience by paying your account TODAY UNTIL OCTOBER 19,2015. Settling this account is the only means to save you from LEGAL PROBLEMS.
I been receiving this messages 3 times in a row everyday nakakagigil when I tried to call the number is unavailable. Totoo ba to or scam kind of worried though. Thank you for reply

In my case, my contract was expired since September 2014. so we asked the Smart comm.on how to terminate the plan since it was already expired and we are no longer interested to extend the contract since the connection is very poor and always disconnected. their employee advised us to pay 1,500php even though our plan is 999, its for other charges daw since we want to cancel our plan, and all we need to do is to stop from paying so that the smart comm will automatically cancelled the plan. After 1 year. September 2015, The smart communication starts to harassed me by texting, calling and mailing from their Law Office. They told us that the plan was cancelled but the account is not and our outstanding balance is 3,200. hahahahaha. funny isn't it? we asked for the proper way on how to STOP THE PLAN AND THEY ARE THE ONE WHO TOLD US TO STOP FROM PAYING, AND NOW, THEY HARASSING ME. OBVIOUSLY, ITS THEIR MODUS. I WISH THAT KARMA WILL VISIT SMART COMMUNICATIONS IMMEDIATELY :)

Hi everyone. If you would back read the comments, the harassment stopped after telling the person who called me that I never got any signal and went to Smart Center to report it. They just stopped after that conversation. Natahimik talaga nung sinabi ko na "nireport ko na, wala pa rin, nag email ako, walang sagot; nagpunta ako sa center, wala din... tapos ngayon nagdedemand kayo."

I would have proceeded with my complaint with the NTC if they hadn't stopped, but they did (Thank goodness).

The harassment peaks during Christmas time because collection agencies know that this is the time when people receive their bonuses (na alam naman nilang may pinaglalaanan na, or worse, naiutang na before).

My advice, ignore them if you are in the right because they were not able to meet their end of the bargain, that is, to provide decent, continuous internet service. If they won't stop, you can resort to the NTC.

As to estafa - deadma. This would not qualify as estafa. They treat us as scums who do not know how to pay when our reason for not paying is their pathetic service. Wag po tayong magpapadala sa kanila. You may consult a lawyer to see how to countercharge them.

Hello po.. Kakareceived ko lng ng letter from sillano and associates law.. Dhil sa seriously overdue daw ng bill ko sa home bro ( smart broadband)... Pinapabayad nila ako ng 35,200 inclusive of charges unpaid... Sabi nila in desire to spare the embarrassment and inconvenienve they make final demand to pay and settle With 11, 200.. Failure to comply mgfifile cla sa court involving a claim up to 100k for speedy resolution amd they will hold me liable for damages amd attorney's fee... Its been 8 months di ko n nagamit ang smart bro bec. Wla tlgang signal.. di man lng ngpadala ng notice for disconnection and bigla n lng cla mgpadala ng ganitong letter... Wat should i do???

We have a computer shop, and on our 2nd branch PLDT ang connection namin pero matagal na naming hindi ginagamit ang connection dahil patagal ko nang pinapadisconnect, tapos nag reply ako ngayon kung anong account no. ang sinasabi nya, i got no response.

Smart at PLDT pareho lang any mga yan. Nag-apply ako ng Plan 1299 sa pldt, after 1 month nagulat ako na may extra cellphone at sim card pala plan ko na hindi ko alam, syempre kailangan ko bayaran yung extra charges, umabot din sa 1800 yung first bill ko kahit di naman nagamit yung sim at cell phone kasi after a month pa nila ibinigay. Then after 3 months yung bill ko 2,300 na considering na pina-cut ko pa yung caller id which is 200/month din. Yun pala ini-upgrade nila ang plan ko sa 1,899 at hindi man lang nagtanong kung papayag ba ko. Nag-complain ako sa hotline at sabi sakin punta nalang ako ssa office nila para sa complain. Ang nakakatawa sa office nila hindi tinanggap yung letter na dala ko about sa complaint at para ipa-revert yung plan sa 1299 di daw tatanggapin yung letter kasi di na daw maibabalik yon dahil sa 2 years na contract.

Ito ngayon sinisingil ako ng 21,000 ng pldt. Tibay naman nila

_ I suggest you go to the nearest Smart Center to explain na walang signal po ang binigay nila at hindi functioning. Ang pagbabayad ay nakabase sa serbisyong binibigay nila. Kung walang serbisyo, dapat wala ding babayaran. Wala din pong nakukulong sa di pagbabayad ng ganyan. Hindi po estafa yan.

- Kahit magfile po sila ng case sa inyo, isasubject din po yan sa mediation. besides po, wala po silang service eh. Sa terms and conditions basaahin nyo po yung pinirmahan niyo - magbibigay sila ng internet. Kung walang nasasagap na signal, eh di ibig sabihin po walang serbisyo. hindi naman tamang magbabayad kayo na wala naman pala kayong pakinabang doon. Kahit magfile pa sila, may laban pa rin po kayo.

I also got the same issue.Lumipat kc kmi ng bahay then, I requested for relocation but for how many months wlang progress na nangyayari, so nag-file nlng ako ng disconnection pero sabi nila hindi dw pwede kc may pending process pa which is ung relocation request.After ilang months uli, binayaran ko nlng ung mga months na d nmin nagamit para lng ma disconnect na pero sabi nila d pa rin dw napra process ung old request, bat kasi ang tagal nila mag-process and dpat nga kmi na ung magalit kc babayaran na nga kahit hindi nagamit tapos hindi pa rin pwede mag-cut ng plan?
Then now, nkaka receive na ako ng text from collection agency na dpat may bayaran ako kung hindi may legal action na dw.
Help nman po, matagal na kc nmin d nagagamit ung smart bro but still may fee pa rin simula ng d nmin nagamit until now and counting.

Ako din po siguro biktima rin ngaun. Ngaun kasing araw pinasesettle sakin ungpera kailangandaw mga 1 o clock kung hindi may interes na 25% ung naging utang ko na 10k. Eh 2months lang ang di ko nabayaran matagal n nilang pinutol. Tapos pinapuputol ko na sa kanila wala silang action. Umabot muna ng 4k pinasettle sa asawa ko na bayaran muna ung 2months dahil un lang talaga ang dapat bayaran. Nag txt naman ung sa smart bro na paid n kami,tapos bigla uling may tatawag na kailangang bayaran pa ung iba. Nagkataon na wala akong trabaho at wala akong ibabayad sa kanila. Hanggang may nagtxt na taga law office na sila ito ngang sillano na ganun nga din ang nasaad sa txt. Kailangan ko daw na esettle kahit n 2k muna daw sabi ng asawa ko. Saan ko naman kukunin un eh ang sahod ko.lang ngaun bilang service driver sa mga pamangkin ko ay 6k lang kulang pa nga sa pambaon ng 4 kung anak. Sila pa ba ang uunahin ko kesa sa mga anak ko. Subra naman sila mahina na nga ung net nila kung minsan nawawla pa tapos ganito ang gagawin na mga yan.

Ms. Matiefeb. Yan nga po yung nakakainis sa kanila kasi po sasabihing libre eh hindi naman pala. Dapat po talaga narereklamo yang ganyang promo sa DTI, at dapat din po ay sa NTC.

Kahit po hindi niyo ireceive ang sulat, considered pa din po yan na received pero refused to receive. Yung iba po, sinasabihan na lang ang kartero na hindi na nakatira yung tao na yun dun para di na magdeliver sa mga bahay nila - kaso depende po yan sa kartero kung susunod sa inyo (dirty tactics po ito, pero meron pong ibang gumagawa kasi below the belt din ang ginagawa ng mga collector).

Having the same problem too! Tawag ng tawag sa amin ung smart bro na idedemanda daw ako because of unpaid bills, eh bakit ko naman babayaran kung wala akong natatanggap na serbisyo. Matagal na namin gustong ipa-cut ung line sa wifi kaso may contract nga daw. Tapos ngayon ako pa ang lalabas na kakasuhan, manigas sila! Gusto ko sana magfile din ng complain against them para naman matigil natong kalokohan nila!

Hi, i've been harassed too by the collection agencies. More than a month i did not have internet signal. They said they will send technician to check but nobody came. So i did not pay for the services that i did not enjoy. Someone called to collect i strongly told them i will not pay. It was not me who breached the contract it was them. They said that they will bring the matter to court and that i have to appear in Makati it would be costly for me. I replied i will just wait for the subpoena then. After that no one ever called me to collect.

Isa ako sa inyo. Pikang pika na ko at nag-aalala na ko dahil till now hindi pa rin sila tumitigil.. and worst palaki ng palaki ang sinisingil nila sakin. Ilang beses na ko nagblocked ng mga pesteng number ng mga collectors na yan pero ala pa din. Hindi naman pwedeng hindi sagutin ang mga unknown numbers baka sakaling kakilala mo or emergency call tapos ayun sabi na nga ba at SMART pa din. Pag tinatanong yung name ko, nagsasabi na lang tuloy ako ng ibang name at address. Palagay ko dapat tayo naman ang magfile ng complaint sa kanila. Dapat magset na tayo ng schedule para sa sabay-sabay na pagrereklamo sa panghaharass nila tutal pareparehas naman tayo ng reklamo.

Hanggang ngayon na nasira ang tulog ko dahil sakanila kaya naman dali-dali na kong nagsearch kung ano bang mangyayari talaga kapag hindi ko binayaran yung pesteng bill ko na pataas ng pataas kahit na matagal na nilang pinutol yung linya ko.
Inabot na ko ngayon ng tanghali sa pagbabasa ng mga comments at advise dito kaya naisip ko..mas maganda nga sana kung sabay-sabay tayong magfafile ng complaint sa NTC para sa panghaharass nila..para matahimik na sila..nakakaalarma pa naman yang mga pinagsasasabi ng law firm na yan..napagod na din ako kakablocked..iba2ng number ginagamit..iba2ng collectors nakakarindi na..
