HARASSMENT FROM SMARTBRO
In 2011, after finding utter disappointment from two (2) major internet providers in the Philippines, hubby went to a Smart Wireless Center and applied for a Canopy Device. When the unit was delivered, the installers suggested that we avail of the Wimax instead since the trees around the neighborhood were blocking the signal.
So, they came back later and delivered the Wimax device. The contract was locked for two years, otherwise, we had to pay pretermination charges.

On the day that Pacman lost to Marquez, on Dec. 9, 2012, we discovered that we had no internet signal. This had happened many times before, sometimes lasting for a few hours, and the most was three days. We never a reversal of the charges since it was too much of a hassle to call their customer hotline at *888. After two or three days of no internet signal (it was forever a running light), we reported the matter to the hotline. The customer service officer merely said to monitor the device for a another 24 hours.
After a few days, the device was still not working (imagine leaving it plugged, with a running light, 24 hours a day, and I can't use it, but I had to plug it on. The useless consumption of electricity, right?) When we called the hotline, the officer asked us to bring it to the center for replacement because it was broken. So hubby went to the Wireless Center to report it and was told that the device will be replace, but to just wait because they had no idea when a device would be available.
So we waited...
And waited...
And waited...
A few weeks after, we called the hotline and asked for an update. Still the same answer- they didn't know when a new device would be available.
After many follows ups, I got a bill for the internet that we could not use. So I called the hotline and they advised me to pay the outstanding balance and have it reversed later. So I said, "you mean, in the more than one month that we have been waiting for an internet connection, I still have to pay?" "Yes", he said, "but you can have the charges reversed when service resumes." I asked, "and when may that be?" He said, "he doesn't know." So I said, "please put this in record that we will not pay because there is no internet service. Why pay for a service that you weren't able to use because of the provider's incompetence?
I followed it up to no avail.
I even sent messages to follow up my reference number to its twitter account @SMARTcares. I never received any reply. That's how much SMART CARES: it ignores you until you collapse and get tired from all the follow-ups. I've sent emails too and they did not reply.
To shorten this depressing story, sometime in March we received a notice of disconnection from Smart. Asking us to pay P12,000+++ for the two months that we had no internet plus pre-termination fee of about P10,000.00.
After that, we have been getting text messages from an ADA Law Office. This afternoon, I received another text message from an office claiming to be the ADA Law Office:
"FINAL SERIOUS DEMAND ( as if we're joking here ----- my addition, not part of the text)
This is A.D.A. Law Office. Your silence & non response to our previous demands indicates your malicious & unjustified refusal to pay a just and demandable obligation on your SMARTBRO. Thus we urge you to settle your outstanding obligation until May 05, 2013 from receipt of this message. (ano daw???)
Otherwise, our law firm will definitely proceed with the filing of appropriate legal action against you pursuant protect the interest of our client SMARTBRO. Any question (hmm) please call (02) 3818527 and look for MS. DELOS REYES. thank u"
Previous text messages contained a different contact person, but the same A.D.A. law office.
I have been checking the list of the law firms in the Philippines and I have yet to see A.D.A. Law Office. If indeed there really is such an office, then that lawyer must be really desperate to get his contingent fee the at he had closed his eyes to the real issue at-hand, and that is, his client (Smart) failed to serve its own client (us). If it's a collection agency, which I think it is, then I have been hearing bad things about them-- harassment is the most applicable word.
I even tried calling it this afternoon, introduced myself as a lawyer, and they said they'd make a return call. Up to now, there's no return call.
Another push and I'll file a complaint with the National Telecommunications Commission.
Which brings me to one point of thought- the lock-in period should not be imposed by internet providers. Because even if their service sucks, the consumer is still the one who loses more with the lock-in period. Add to that, a simple Filipino may get easily harassed by these oppressive telecom giants. The price of technology --- a way for these telecom giants, particularly SMART to milk us for every cent we are worth.
Any of you here who is being harassed by the inefficient Smart too?

Personally, I will not pay it. How would you pay for unstable or no internet connection at all.
Kaya may lock in period kasi walang guarantee ang smart na makaka deliver sila ng matinong internet connection. Remember their promise "upto 1 mbps". Pag titignan mo naisahan tayong lahat, pag ang internet connection mo ay 1 byte basta upto 1 mbps yan, yan yung sabi sa marketing nila na "upto 1 mbps".
Lumipat na ako sa PLDT myDSL maganda ang service so far. Hindi ko babayaran ang Smart hindi dahil sa walang pambayad kung hindi dahil wala akong serbisyong natatanggap (unstable internet connection)sa SmartBro nila.
If in 5 months from now, I will recieve those demand letters, I will just disregard them, and it will not affect me at all.
Hindi ba't sila ang lumalabag sa breach of contract regarding sa services rendered?
Sana silipin yung "upto 1 mbps" nila kasi dyan tayo nalusutan. so kahit anong speed kahit na i deliver nila 0.00001 mbps pasok sya sa upto 1 mbps. tsk tsk tsk
Napaka-oppressive talaga ng lock-in period nila, wala namang kwenta ang service.
Sayang nga, mabilis pa naman sana ang service, kaso nga lang, pag nawala, tuloy-tuloy!!!

I'm not sure how to deal with this situation really but as far as I know, I'm not really at fault here. I do know my rights and u want to know what exactly I'm gona pay for. And yes their service is absolutely horrible.

Naka receive din kasi ako last month ng letter na kailangan din magbayad ng more than 15k. Nag stop na rin kasi ako sa pag babayad kasi palpak yung serbisyo nila. Tatanong ko lang kung ano na nangyari sayo after 1 year?

May tumawag din sakin kanina lang from Lauron Delos Reyes Law firm. Kailangan ko daw mag bayad hanggang bukas kung hindi may legal action daw silang gagawin. Any update sa mga subscriber na binabantaan ng Law firm?

And the man I was talking to said that he would inform his boss about it and to let them know once signal has resumed.
I said, I will inform him right away. But since I never got anymore reply from Smart (email or call), I didn't call them anymore. And that was the last call I got from the law office. I'm guessing, this was about October of last year.
In short, hindi na ako tinawagan or pinadalhan pa ulit ng demand letter to pay for a service that I did not enjoy.

You still adamantly refuse to settle your overdue account. Be advised that unless payment in full of the above-mentioned balance is received within 24hours, this will effectively damage your credit rating for the past year.

They can file a case against us, pero our defense is that walang service in the first place. But I don't think they would go to such length. Ang daming complaints against them, ang kapal naman nila. Pang-haharrass lang ang gagawin nila hanggang sa mainis tayo.

Ganyan po ka-halang ang kaluluwa ng mga law firm at ng mga empleyado na humahabol sa quota para may commission.
Hindi ko naman po nilalahat. Pero pag collecting agency po ng credit card, utilities, like phone, networks, asahan niyo po na wala silang pakialam sa kung ano ang tama o mali. Basta may list sila at nandun ang pangalan natin, di na tayo tatantanan.
You can always ignore their demands, pero they can be persistent. The best option is to complain to the NTC if you can no longer tolerate their harassment.

In my case, I have received an awful internet connection from the 3 month onwards. I have regularly contacted the customer service and they have sent a technician ONLY ONCE. On the 6th month, the internet service finally went off. I made several follow-ups and nothing happened. Tapos since meron silang lock-in period na sinasabi, I decided to continue paying for that pesky internet service na never kong nagamit.
Then nung mag-expire na yung contract, this customer service rep kept on calling to continue the service. Sabi ko, NO! HINDI KO NGA NAGAGAMIT UNG SERVICE TAPOS ITUTULOY KO PA UNG KONTRATA? tapos nagulat na lang ako may bill nanamangf dumating. I tried calling the customer service nila at sinabi kong i-cancel yung account. Hindi raw. I made several calls to no avail and finally, ayoko na. I started ignoring them until this ADA Firm texted up. Grabe.. this law firm would ran after me dahil lang sa P3000 plus na bill??? And to think that hindi ko yun nagamit ever???
I wish SMART would work on this. And if every someone out there would like to file a complaint, please do keep in touch. Mas maganda kung madami tayong makikipagtulungan na sugpuin ang kolokohan na ito ng SMART.

This texter might be using some words to make a Psy-war so that i will may quickly make an action to fulfill my bill before their due date even 'though i didn't have a good experience with their service. I did not yet reply any message to them yet. And also, their message seems to be very unprofessional i've been also i a Customer Service and Marketing Department of a Company but i've done any message or letter like that. Also, if they we're about to fill a Case against me i thought they should have to give me at least 30 days from the day(Today) they've send me a notice and that's the proper and legal notice. That message seems to be too unprofessional.

-yung last letter na nareceived ko October last year nasa 5K+ lang yun and then nung tumawag nung May nasa 13K na daw. 1 month na monthly lang ang hindi ko nabayaran nun pero naging 5K+ na agad. Saka may naalala ko dapat September last year tapos na ung 6-month contract na sila ang gumawa, July last year nung masira ang internet ko, so dapat hindi na yun lumaki ng 13K di ba. Plano ko makipag usap sa smartbro na yung tablet lang ang babayaran ko pero hindi ung internet na hindi ko nagamit. Sana pumayag kasi wala naman akong plano takbuhan yung pagbabayad, nagkataon lang talaga na hindi maganda ang service nila.
pero ang txt nya is 23k. sabi ko bat ko babayaran ung diko naman nagamit! mkpag usap nlng dw ako sa pldt pra daw di nila ipadala demand letter skin.hahaha.

I would have proceeded with my complaint with the NTC if they hadn't stopped, but they did (Thank goodness).
The harassment peaks during Christmas time because collection agencies know that this is the time when people receive their bonuses (na alam naman nilang may pinaglalaanan na, or worse, naiutang na before).
My advice, ignore them if you are in the right because they were not able to meet their end of the bargain, that is, to provide decent, continuous internet service. If they won't stop, you can resort to the NTC.
As to estafa - deadma. This would not qualify as estafa. They treat us as scums who do not know how to pay when our reason for not paying is their pathetic service. Wag po tayong magpapadala sa kanila. You may consult a lawyer to see how to countercharge them.

We have a computer shop, and on our 2nd branch PLDT ang connection namin pero matagal na naming hindi ginagamit ang connection dahil patagal ko nang pinapadisconnect, tapos nag reply ako ngayon kung anong account no. ang sinasabi nya, i got no response.
